Official Rules
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. GENERAL: Participation in the "Dunn-Edwards Modernism Week 2022 Trip Sweepstakes" (the “Sweepstakes”) constitutes the entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.
3. TIMING: The Sweepstakes begins at 9:30 a.m. Pacific Time on January 18, 2022 and ends at 11:59 p.m. Pacific Time on February 1, 2022 (the "Promotion Period"). The winner will be selected from entries properly submitted during the Promotion Period.
4. MULTIPLE ENTRIES: Multiple entries by a single entrant will be allowed.
5. ELIGIBILITY:
A. To enter and to be eligible to win, entrants must be 21 years of age or older by the time of entry, and not otherwise ineligible to participate in the Sweepstakes as provided herein.
B. The Sweepstakes is only open to legal residents of the United States and its territories and possessions, including residents of the District of Columbia and Puerto Rico.
C. Employees of Dunn-Edwards, its affiliates, subsidiaries, advertising and promotion agencies or suppliers (“Employees”); parents, siblings and children of Employees; and persons domiciled with Employees, are ineligible to enter.
D. Entrants who do not meet the aforementioned eligibility requirements will be disqualified.
E. All applicable federal, state, and local laws and regulations apply. Void where prohibited by law.
A. All eligible entrants who, during the Promotion Period, sign up on dunnedwards.com to receive commercial email communications from Dunn-Edwards, H3K Design, and Grace Home Furnishings, and complete all of the required entry fields (including the field that acknowledges agreement with these Official Rules), will automatically be entered into the Sweepstakes. You may unsubscribe from any of these e-mail communications at any time.
B. You may enter the Sweepstakes without signing up to receive e-mail communications from Dunn-Edwards or any other entity by (1) mailing a written communication to Sponsor at its address set forth in paragraph 2 above listing your name, residential address, email address, and age, and requesting to enter the Sweepstakes; and (2) ensuring that such written communication is received by Sponsor during the Promotion Period.
7. PUBLICITY: As a condition of entry into the Sweepstakes, except where prohibited by law, each entrant, and each potential Sweepstakes winner by accepting the prizes, grants to Sponsor a perpetual, worldwide, royalty-free license and right to publicize, broadcast, display, and/or otherwise use the Sweepstakes entrant’s name, city and state of residence, biographical and other likeness materials (collectively, “Licensed Rights”) in any media now known or hereafter devised throughout the world in perpetuity for advertising and publicity purposes, without additional review, compensation, permission, or approval.
8. SELECTION OF SWEEPSTAKES WINNER: Only one Sweepstakes winner will be awarded. The winner will be selected on or about February 3, 2022 and awarded the prizes. Odds of winning will depend on the number of apparently eligible entries received during the Promotion Period. The potential Sweepstakes winner will be notified via e-mail to the e-mail address provided by the entrant on the Sweepstakes entry form or authorization for sending commercial e-mails. The drawing will be conducted by Sponsor, whose decisions on all matters relating to the drawing shall be final and binding. At the sole discretion of Sponsor, disqualification, forfeiture, and the selection of an alternate winner may result from any of the following: (1) the potential winner’s failure to respond to email notification of winning within one week after its transmission; (2) the return of an email notification as undeliverable after three attempts; (3) the potential winner’s failure to provide Sponsor with satisfactory proof of age, identity, residency, and eligibility; (4) the potential winner’s failure to execute and return a Likeness Release, or similar document, in the form requested by Sponsor within 14 days after its transmission to the potential winner; and (5) any non-compliance with these Official Rules. In the event of a forfeiture, the prizes shall be awarded to an alternate winner selected by Sponsor by a random drawing from all remaining apparently eligible applicants. All prizes will be awarded.
9. PRIZES: The Sweepstakes winner will be receive the following prizes, the approximate retail values (ARV) of which are as indicated:

Prizes are subject to applicable terms and conditions. The approximate aggregate ARV of the prizes is $3,995.16. Prizes are non-transferable. No substitutions or cash redemptions will be allowed. However, Sponsor reserves the right to substitute a prize, or a component thereof, for cash of equal or greater value if the designated prize should become unavailable for any reason.
10. TAXES: All taxes on prizes, if any, and other expenses related to accepting and/or using a prize, are the sole responsibility of the Sweepstakes winner. The Sweepstakes winner will be issued a Form 1099 in the amount of the aggregate ARV of the prizes.
11. LIMITATION OF LIABILITY. By entering or participating in the Sweepstakes, participants agree to be bound by these Official Rules, and by the decisions of Sponsor, which are final and binding in all respects. Neither Sponsor nor any of its affiliates, advertising agencies, representatives, or any of them, nor any of their respective officers, directors, agents, or representatives (all of the foregoing, "Sponsor Entities"), is responsible for: (1) any incorrect or inaccurate information or technical failures of any kind; (2) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (3) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of entries, or the selection or notification of the Sweepstakes winner. Entries are considered only upon receipt. Submission by email or other electronic means (except in the case of individuals who are automatically entered by virtue of their signing up to receive commercial e-mails and completing all required entry fields) is not considered proof of delivery or receipt. Sponsor reserves the right at its sole discretion to disqualify the entry of any individual found to be (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any website operated by the Sponsor Entities; (b) using any robotic, macro, automatic, programmed or like entry methods; (c) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person. Sponsor Entities are not responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Sweepstakes; participation in any activity or travel related to this Sweepstakes; or any interaction with, or downloading of, computer Sweepstakes information.
12. Conditions of Entry: Entry materials that have been tampered with or altered are void. If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer viruses, bugs, unauthorized interventions, fraud, technical difficulties, or other failures compromise, corrupt, or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and void any entries submitted fraudulently, to modify the Sweepstakes, or to terminate the Sweepstakes and conduct a random drawing to select the Sweepstakes winner using all eligible, non-suspect entries received as of the termination date. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on Sponsor's website.
13. ENTRANT INDEMNIFICATION OBLIGATIONS: By entering or participating in the Sweepstakes, each entrant agrees to defend, indemnify, release, and hold harmless the Sponsor Entities (and each of them) from and against any and all losses, demands, damages, rights, claims, actions, and liabilities of any kind arising out of or related to (1) the entrant’s participation in the Sweepstakes, or (2) the entrant’s participation in any prize-related activities (including, without limitation, any property loss, damage, personal injury, or death caused to any person(s)). Each entrant assumes all liability for any injury, death, or damage caused, or allegedly caused, by participating in the Sweepstakes or use or redemption of any prize.
14. DISPUTES: Except to the extent prohibited by law, each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by appropriate state or federal courts located in Los Angeles County, California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; (3) under no circumstances will the entrant be permitted to obtain awards for, and the entrant hereby waives all rights to claim, indirect, punitive, incidental, consequential, or any other damages of any kind, save only actual out-of-pocket expenses; and (4) the entrant hereby waives any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of California.
15. PERSONAL INFORMATION: The personal information collected through the Sweepstakes is subject to Sponsor's Privacy Policy, which can be found at https://www.dunnedwards.com/about/privacy-policy. By entering the Sweepstakes, each entrant agrees to the use of his or her personal information as described herein and in Sponsor's Privacy Policy.
16. WINNER LIST: For the name of the Sweepstakes winner, visit [https://dunnedwards-6537909.hs-sites.com/en/mw-sweepstakes]. The name of the winner will be posted after winner confirmation is complete.
