Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND DISTRICT OF COLUMBIA WHO ARE AT LEAST TWENTY-ONE (21) YEARS OF AGE AT TIME OF ENTRY. VOID WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW.
1. ELIGIBILITY. The CELEBRITY ESCAPE TO THE CARIBBEAN GIVEAWAY (“Giveaway” or “Promotion”) is open only to legal residents of the fifty (50) United States (including the District of Columbia) who are at least twenty-one (21) years old at the time of entry. Employees of Celebrity Cruises, Inc., Administrator and Promotion Partners (defined below) and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Giveaway is subject to all applicable federal, state, provincial and local laws and regulations. Participation constitutes entrant’s full and unconditional agreement to these Official Rules. Sponsor’s and Administrator’s decisions are final and binding in all matters related to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. PROMOTION PERIOD. The Celebrity Escape to the Caribbean Giveaway (“Giveaway” or “Promotion”) begins at 12:00 a.m. Eastern Time (“ET”) on March 27, 2024 and ends at 11:59 p.m. ET on April 27, 2024 (the “Promotion Period”).
3. SPONSOR AND ADMINISTRATOR. Sponsor is Celebrity Cruises, Inc., 1050 Caribbean Way, Miami, FL 33142(“Sponsor”). Administrator is Winni, LLC, 15 N. Southwood Drive, Nashua, NH 03063 (“Administrator”). Promotion participants include Girlboss Holdings, Inc., Dotdash Meredith, (d/b/a Food & Wine), MH Sub I, LLC (d/b/a Fodor’s Travel), SheFinds, Travel Curator, LLC, and Frommer Media, LLC (d/b/a Frommer’s) (collectively with Sponsor and Administrator, the “Promotion Partners”). See Sponsor’s Terms of Use and Privacy Policy.
4. HOW TO ENTER. During the Promotion Period, you must enter the Promotion by:
a) Visiting the Promotion site https://www.dojomojo.com/landing/campaign/4871c92e-7f21-46b6-bd9e-fe6eb941982b (the “Promotion Site”) and fully completing the FREE Giveaway entry form, including providing your first and last name, valid email address, and zip code.; and
b) Reviewing and acknowledging that you agree to the Official Rules and agree to receive marketing email communications from the Promotion Partners. You may opt-out of receiving marketing emails at any time after entry. See Section 9 of the Official Rules for more details.
c) ALTERNATIVE MEANS OF ENTRY. Alternatively to 1 & 2, you may enter by mail by sending, on a plain 3” by 5” index card, legibly hand printed or typed, an entry with your first name, last name, mailing address, telephone number with area code, and email address (if any, and if you wish to provide it), to “The Celebrity Escape to the Caribbean Giveaway” c/o Winni, LLC at 15 N. Southwood Drive, Nashua, NH 03063. Mailed entries must be mailed with sufficient postage and postmarked during, and received no later than, three (3) days after the end of the Promotion Period and will be entered into the drawing after receipt.
LIMIT ONE (1) ENTRY PER PERSON. ADDITIONAL ENTRIES WILL BE DISQUALIFIED. Multiple entrants cannot share the same email address. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different email addresses, identifiers, registration and/or logins, or any other methods is prohibited and may void the entrant’s entries and result in disqualification. The use of any automated system to enter is strictly prohibited and Sponsor and Administrator reserves the right to disqualify any entries received through such methods, as determined by Sponsor and Administrator, in their sole discretion. In the event of a dispute as to any entry, the authorized account holder of the email address used to enter will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email address for the domain associated with the submitted address. The prospective winner may be required to show proof of being an authorized account holder.
5. AGREEMENT TO OFFICIAL RULES. Participation in the Promotion constitutes entrant’s full and unconditional agreement to these “Official Rules” and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Promotion. Winning the prize is contingent upon fulfilling all requirements set forth in these Official Rules.
6. SELECTION AND NOTIFICATION OF WINNING ENTRY. Sponsor and/or Administrator will select one (1) potential winner in a random drawing from all eligible entries after the close of the Promotion Period (“Prospective Winner”), which will take place on or around May 2, 2024. The Prospective Winner will be notified via the email address provided in the entry form on or around May 5, 2024. The Prospective Winner must meet all eligibility and prize fulfillment requirements set forth in these Official Rules to be deemed as the winner and eligible to receive the prize (“Winner”). Winner also will be required to provide his/her tax payer ID number or social security number or W9 for tax purposes where prize value requires it (prizes with an ARV over $600 will be reported on a US 1099 form).The Prospective Winner will be required to sign and return a Declaration of Compliance, Liability Waiver and where not prohibited a Publicity Release ("Declaration") which must be completed to Sponsor’s and Administrator’s satisfaction, and received by Sponsor or Administrator, as directed, within four (4) days of the date notice or attempted notice is sent, in order to claim the prize. If a Prospective Winner cannot be contacted, fails to sign and return the Declaration or provide any other requested information within the required time period, cannot sail per the Prize, or the prize is returned as undeliverable, the Prospective Winner forfeits the prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that a Prospective Winner is disqualified for any reason or forfeits the prize, Sponsor may, in its sole discretion, award the prize to an alternate winner by random drawing from among all remaining eligible entries until an eligible winner is selected.
7. PRIZE. ONE (1) GRAND PRIZE. The Prize is a seven (7) day Celebrity Cruise Western Caribbean cruise for the Winner and one guest in a Veranda stateroom (single room double occupancy) departing on November 2, 2024 from Fort Lauderdale, Florida. The Prize includes the Classic Drinks package and basic Wi-Fi. Specialty dining not included. Complimentary dining available in all main dining areas. All taxes, fees, port expenses, and gratuities are not included. Prize has an approximate retail value (“ARV”) of $4,089.04. WINNER MUST BE ABLE TO SAIL NOVEMBER 2, 2024. NO SUBSTITUTIONS ALLOWED. Winner must provide a major credit card upon check-in. All other trip-related taxes and expenses, including but not limited to hotels, airfare, additional transportation, onboard incidentals, land programs, any upgrades, or any other additional expenses not set forth herein, are excluded from the Prize and are solely the responsibility of the Winner. Any available add ons or upgrades may be purchased at an additional cost and will be subject to the cruise line or other travel provider’s cancellation policy. Winner and Winner’s guest must BOTH be 21 years of age. Winner’s guest must travel on same itinerary, in the same stateroom and at the same time as the Winner. If Winner elects to travel or partake in the Prize without a guest, no additional compensation will be awarded to such Winner. Travel restrictions, conditions and limitations may apply. The Prize is not transferable and shall not be substituted for any other cruise or sailing date or other prize. Winner will not receive the value of any difference between the approximate retail value and actual retail value of the prize(s). Winner and Winner’s guest are subject to all Celebrity Cruises guest terms and conditions. Prize will not be replaced if lost or stolen, or not redeemed, and are not redeemable for cash, unless required by law. Winner understands that there are inherent risks involved in travel and that these risks may be present before, during and after the trip. All expenses, including taxes, not specifically mentioned herein are not included as part of the prize(s) and are solely the Winner’s responsibility. Winner and Winner’s guest are solely responsible for obtaining valid passports and any other documents necessary for travel. Winner and Winner’s guest are solely responsible for their own conduct while accepting the Prize and agree to comply with all applicable laws and regulations pertaining to use and enjoyment of the Prize. Winner’s guest will be required to sign a Declaration, including Publicity Release where permitted, prior to issuance of the Prize.
8. ODDS OF WINNING. Odds of winning depend on number of eligible entries received during the Promotion Period.
9. FUTURE OFFERS. By entering this Promotion, entrants agree to receive emails, special offers and electronic newsletters from, or on behalf of, Sponsor, Administrator and each Promotion Partner for online direct marketing purposes, including but not limited to emails and future offers and promotions from Promotion Partners and brands listed above. Entrant’s personally identifying information, including but not limited to contact and entry information, will be shared among Sponsor, Administrator and Promotion Partners. At any time after entry and prior to the close of the Promotion Period, entrants may opt out of receipt of emails and other offers by contacting Sponsor, Administrator and each Promotion Partner and asking to unsubscribe. After entry, entrants may opt out of any of these mailing lists by following the unsubscribe process provided by Sponsor, Administrator and each Promotion Partner or brand; however, Sponsor or Administrator may email entrants in connection with this Giveaway, including winner notification. Opting out will not decrease your chance of winning in the Promotion. Opt out provisions above apply. In connection with the Promotion entry process, the website hosting platform (Innovative Bands Corp. d/b/a DojoMojo) and Sponsor, Administrator and Promotion Partners and brands may collect and use personal data about entrants on the Website in accordance with their privacy policies. By participating in the Promotion, you hereby agree to the collection and usage of your personal information and acknowledge that you have read and accepted the corresponding privacy policy for Sponsor, Administrator and each Promotion Partner. 10. PERMISSION TO PUBLISH. Except where prohibited, entrants grant Sponsor, Administrator and Promotion Partners permission to publish his/her name, town/city and state of residency on their websites or promotional materials in the event of winning. Entrants also grant permission to release full names on a Winner’s list to individuals requesting a mailed copy of same or as required by any state registration authority.
11. RELEASE AND LIMITATION OF LIABILITY. Sponsor, Administrator or Promotion Partners and each of their respective successors, assigns, affiliates, subsidiaries, parent companies, members, advertising and promotion agencies, and each of their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, “Released Parties”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omissions, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to your or any other computer relating to or resulting from participation in this Promotion; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; transactions that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any web site; printing or human or other errors; and any entries which are late, lost, incomplete, misdirected, stolen, or any combination thereof. Online submission is not considered proof of delivery or receipt. By entering this Promotion, you agree to release, discharge, indemnify and hold harmless the Released Parties, their assigns, their respective representatives and agents, their marketing, advertising and promotion agencies, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages or liability arising in connection with your participation and/or entry in the Promotion and/or your receipt or use of any prize awarded in this Promotion or due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion.
12. PUBLICITY. Except where prohibited by law, the Winner's entry and acceptance of the prize constitutes permission for Sponsor, Administrator and each Promotion Partner and its assigns to use said Winner's names, photographs, likenesses, statements, biographical information, voices, and city and state addresses on a worldwide basis, and in all forms of media, in perpetuity, without further compensation.
13. DISPUTES/GOVERNING LAW. Except where prohibited by applicable law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Southern District of Florida or the appropriate State Court located in Miami-Dade County, Florida; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.
14. SEVERABILITY. If any provision of these Official Rules shall be held invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provision will not be affected or impaired, provided, however, that the parties use their best efforts to achieve the purpose of the invalid provision by a new legally valid stipulation.
15. COPY OF OFFICIAL RULES AND WINNER’S LIST. To obtain a copy of these Official Rules or a list of prize Winner(s), send a self-addressed, stamped envelope to “The Celebrity Escape to the Caribbean Giveaway,” c/o Winni, LLC, 15 N. Southwood Drive, Nashua, NH 03063. You must specify what you are requesting. Vermont residents may omit the return postage requirement.
16. RIGHT TO CANCEL OR SUSPEND CONTEST. If for any reason this Promotion is not capable of running as planned, due to technical failures, or any other causes beyond the exclusive control of Sponsor or Administrator, or that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Promotion. Sponsor has the right to substitute the Prize in its sole discretion.
17. INDEPENDENT PROMOTION PARTNERS. Sponsor, Administrator and Promotion Partners are independent of one another and nothing herein shall constitute (or be deemed to constitute in law or in equity) a partnership, agency, fiduciary, employment, or joint venture relationship between the Promotion Partners. The Sponsor, Administrator and Promotion Partners are not, and will not be deemed to be, the legal representative or agent of any other, nor shall any of the Sponsor, Administrator or Promotion Partners have the right or authority to assume, create, or incur any third-party liability or obligation of any kind, express or implied, against or in the name of or on behalf of another. In addition, none of the Sponsor, Administrator or Promotion Partners shall be deemed to be a member of a partnership with the other for tax or any other purpose other than as set forth herein.
18. PROMOTION PLATFORM. The Promotion hosting platform is DoJoMojo https://www.dojomojo.com/.
19. THIRD PARTY PLATFORMS. This Promotion may be promoted on certain third-party platforms (e.g. Facebook, Twitter, Instagram)(“Third Party Platforms”). By participating in this Promotion, entrants hereby release and agree to comply with the rules and policies set forth by such Third Party Platforms and hold harmless such Third Party Platforms from any and all liability, loss or damages arising from or in connection with the awarding, receipt, and/or use or misuse of prizes or participation in any prize related activities. Unless otherwise stated to the contrary in these Official Rules, this Promotion is not sponsored, endorsed or operated with any Third Party Platforms.
