Eligibility: The Giveaway is open only to legal residents of the continental
United States and the District of Columbia, excluding the state of Rhode
Island, who are 21 years or older at time of entry. Only entrants located in
and logging onto the Internet from within the continental United States or the
District of Columbia are eligible to enter the Giveaway. The following persons
are not eligible to enter the Giveaway: (a) employees of Barney’s, Inc., its
parent, affiliates or subsidiaries, (b) any entities or organizations directly
affiliated or involved with this Giveaway, (c) all parents, agents, affiliates,
subsidiaries, and advertising and promotion agencies of any person or entity in
(a) or (b) above and (d) immediate family members and persons living in the
same household, whether or not related, as any of the persons identified in
(a), (b) and (c) above. The Sweepstakes is subject to all applicable U.S.
federal, state, provincial, municipal, territorial and local laws and
regulations and is void where prohibited by law. By participating in this
Giveaway, you agree to be bound by these Official Rules and the decisions of
Sponsor, which are binding and final in all matters relating to this Giveaway.
Giveaway Period: This Giveaway
begins on Sunday,
July 14, 2019 at 12:00 AM ET and ends on Saturday, August 3, 2019 at 11:59 PM ET (the
“Giveaway Period”).

How to Enter: During the Giveaway Period:

Go to Barneys.com or BarneysWarehouse.com and enter
your email address into the sweepstakes pop-up window OR enter by visiting the
sweepstakes site and completing the Sweepstakes entry form OR by providing your
email to a store associate in Barneys or Barneys Warehouse.

Entries submitted using any kind of bot or automated
technology will be immediately deleted and disqualified.
Prize: Subject to verification of
eligibility and compliance with these Official Rules. Prizes will be
awarded to two winners, one for Barneys stores and Barneys.com (together, the
“Barneys Prize”), and one for Barneys Warehouse and BarneysWarehouse.com
(together, the “Warehouse Prize”). The approximate retail value (“ARV”) of the Barneys
Prize is $1,000 USD and for the Warehouse Prize is $500. The Barneys Prize and
the Warehouse Prize will each be awarded after the Giveaway Period. Sponsor
reserves the right to change or substitute the Barneys Prize or the Warehouse
Prize with one of comparable or greater value in its sole discretion. Winner is
responsible for all applicable federal, state and local taxes, if any, as well
as any other costs and expenses associated with prize acceptance and use not
specified herein as being provided. All prize details are at Sponsor’s sole
discretion.
Winner Selection:
On or about August 30, 2019 at 10:00 AM ET, Sponsor will select
a winner for each of the Barneys Prize
and the Warehouse Prize. Decisions are final and binding in all matters related
to this Giveaway. Odds of winning depend upon the number of eligible entries
received.
Notification and Verification of
Winner: The winner of the Barneys Prize and the winner of the Warehouse Prize
will be notified on Friday, August 30, 2019 via email and have 48 hours to
claim their prize before being deemed ineligible. If a winner is deemed
ineligible in any way, the prize will be forfeited and an alternate winner will
be selected from a separate drawing. The
Neither the Barneys Prize nor the Warehouse Prize may be substituted, assigned
or transferred except at the sole discretion of Sponsor. Sponsor reserves the right, in its sole
discretion, to: (i) verify any element of any entry, related materials or
entrant’s eligibility; (ii) to request additional information; and (iii) to
disqualify any entrant whose participation may subject this Giveaway, Sponsor
or Sponsor’s advertisers, clients or customers to controversy, negative
publicity, scorn or ridicule. By
entering this Giveaway, you agree to provide any documentation or information
deemed necessary by, and in a form acceptable to, Sponsor to satisfy the above
requirement(s) if asked by Sponsor to do so.

Privacy: Sponsor will collect personal data about entrants. Please
review Sponsor’s privacy policy at Barneys.com. By participating in this Giveaway,
you agree to Sponsor’s collection and usage of your personal information and
acknowledge that you have read and accepted Sponsor’s privacy policy. Except where prohibited by law, entry into
this Giveaway constitutes permission to use each entrant’s name, hometown,
voice, biographical information, likeness, photograph and any statements
regarding this Giveaway, in whole or in part, without review, approval, credit
or attribution, notification or payment from or to entrant or any person or
entity, worldwide, in perpetuity, or on a winner’s list, if applicable. IF YOU DO NOT WISH TO SHARE YOUR INFORMATION,
DO NOT ENTER THIS GIVEAWAY.
Arbitration: Except where prohibited by law, as a
condition of participating in this Giveaway, entrant agrees that: (1) any and
all disputes, claims and causes of action arising out of or connected with this
Giveaway, or the prize awarded, shall be resolved individually, without resort
to any form of class action; and exclusively by final and binding arbitration
under the rules of the American Arbitration Association (AAA) and held at a AAA
regional office in New York, New York, (2) the Federal Arbitration Act shall
govern the interpretation, enforcement and all proceedings at such arbitration,
and (3) judgment upon such arbitration award may be entered in any court having
jurisdiction. Under no circumstances
will entrant be permitted to obtain awards for, and entrant hereby waives all
rights to claim punitive, incidental or consequential damages including
attorney’s fees or any other damages, other than for entrant’s actual
out-of-pocket expenses (i.e., costs associated with participating in this Giveaway),
and entrant further waives all rights to have damages multiplied or increased.
Release/ Limitation of
Liability: All participants in this Giveaway
release and hold harmless from any and all actions, claims, injury, loss or
damage of any kind arising in any manner from or in connection with, in whole
or in part, directly or indirectly from, this Giveaway or acceptance or use or
misuse of any prize won: (a) Sponsor and its shareholders, parents,
subsidiaries and affiliates, (b) any entities or organizations directly
affiliated or involved with this Giveaway, and (c) shareholders, parents,
subsidiaries, directors, officers, employees, consultants, advisors and agents
of any person or entity in (a) or (b) (collectively, the “Released Parties”).
Miscellaneous conditions: None of the Released Parties assume any responsibility, and
shall not be liable, for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure, theft or
destruction or unauthorized access to, or alteration of, entries. None of the
Released parties shall be responsible, and shall not be liable, for any
problems or technical malfunction of any telephone network or telephone lines,
computer on-line systems, servers, or providers, computer equipment, software,
failure of any email or entry to be received by Sponsor on account of technical
problems, human error or traffic congestion on the Internet or at any website,
any combination thereof, or any other
reason including, but not limited to, as a result of any injury or damage to
participant's or any other person's computer relating to or resulting from
participation in this Giveaway or downloading any materials in this Giveaway.
Sponsor reserves the right in its sole and absolute discretion to cancel,
terminate, modify or suspend this Giveaway at any time, including, but not
limited to, as a result of any infections by computer virus, bugs, tampering,
unauthorized intervention, fraud, technical failures, or any other causes or
reason. Sponsor reserves the right in its sole discretion to disqualify any
individual who tampers with the entry process in any way. No Released Party
shall be responsible for lost, late, incomplete, stolen, illegible, or misdirected
entries due to any reason. This Giveaway
is subject to all applicable U.S. federal, state and local laws and
regulations.
